Why a Broad FDA Claim Should Start a Clarification Process
“FDA compliant” does not identify what has been reviewed, under which conditions, or for which product configuration. A food package can include several relevant elements: a substrate, coating, adhesive, ink, laminate, additive, and—where applicable—a lid, seal, or label. The useful question is not whether a supplier can make a broad statement. It is whether the supplier can connect evidence to the exact food-contact article and the intended use.
FDA’s inventory explains that food-contact substances are authorized by identity, intended use, and conditions of use; a substance’s appearance in the inventory does not authorize every use or every condition.[1] In parallel, 21 CFR Part 174 describes general provisions for indirect food additives, including good-manufacturing-practice restrictions, applicable limitations, and suitability of purity for the intended use.[2]
For procurement, this means that a generic declaration should be treated as a lead to investigate—not as final product approval.
Start With a Defined SKU and a Configuration Record
Before asking for documents, create a one-page product identification record. It should include:
- supplier name and manufacturing site, if known;
- supplier SKU, buyer item code, product photo, drawing, and revision date;
- full configuration, including the container, lid, seal, coating, print, adhesive, and any food-contact accessory;
- material layers from food-contact surface outward, with trade names or resin/paper/chemical identifiers where available;
- the market where the finished pack will be sold or used; and
- lot, production date, or change-control reference when the project has moved beyond sampling.
A document that identifies only a product family, a generic material name, or an unrelated sample does not yet establish that it applies to the item being purchased. Ask the supplier to state explicitly whether each record covers the proposed SKU and configuration, including any customized print or coating.
Ask for the Exact Regulatory Basis, Not a Conclusion
Request a written regulatory cross-reference for every food-contact layer or component that is relevant to the proposed use. The response should name the route being relied on—for example, the applicable 21 CFR citation, an effective food-contact notification where relevant, or another documented basis—and state the conditions and limitations that accompany it.
The buyer should be able to trace the response in both directions:
- From the package to the evidence: Every food-contact layer and component has a named material and a linked document.
- From the evidence to the package: Every cited regulation, notification, declaration, test report, or specification identifies the substance or structure it supports and the intended use it covers.
Do not accept a list of regulations with no material mapping. Likewise, do not assume that a material name alone proves that a finished, printed, laminated, or converted package is within the cited conditions.
Define the Food Type Before Reviewing the Documents
The intended food must be described in practical terms. Ask the internal menu, product-development, or operations team to identify whether the package will contact, for example:
- dry foods;
- aqueous or high-moisture foods;
- acidic foods;
- fatty or oily foods;
- alcoholic foods, if relevant;
- frozen foods; or
- mixed meals containing sauce, oil, or liquid components.
Record the actual food-contact surface and whether the food may touch an interior coating, a seam, a lid underside, or another component during filling, transport, reheating, or storage. A package selected for a dry bakery item should not automatically be evaluated as though it had the same intended use as a hot, oily, acidic meal.
Record Temperature and Contact Time as a Use Profile
Temperature is not a single product adjective. State the full foreseeable profile:
- filling temperature and the highest expected temperature;
- holding, delivery, refrigeration, freezing, or reheating stages;
- whether the package will be used in a microwave, conventional oven, or other process, if applicable;
- typical and maximum food-contact duration; and
- whether contact is repeated, prolonged, or limited to a short service period.
Ask the supplier to connect this profile to the limitations in the requested regulatory basis and supporting documents. If the supplier provides a temperature range, ask what the range means: the tested condition, the documented condition of use, a material-processing limit, or a commercial recommendation. These are not interchangeable.
Request a Usable Supporting-Document Package
A defensible procurement file normally needs more than a one-page declaration. Depending on the structure and intended use, request the available documents below and check their scope:

A test report can support a defined question, but it does not automatically replace the need to understand the material structure and regulatory basis. Conversely, a declaration should not be treated as a blanket substitute for a test where the buyer’s risk assessment, customer requirement, or intended use calls for more evidence.
Identify Gaps Before You Approve the Purchase
Keep the SKU in a “needs clarification” status if any of these questions cannot be answered:
- Does the evidence cover every food-contact layer and accessory in the proposed configuration?
- Does it cover the food categories, temperature profile, and contact duration in the intended use?
- Is the cited basis specific enough to verify limitations, rather than a generic reference to FDA?
- Does the document name the actual manufacturer, facility, or supply chain relevant to this order?
- Are customized inks, coatings, adhesives, labels, or closures within the reviewed configuration?
- Has the destination market been confirmed, including any requirements outside the federal food-contact framework?
- Is there a documented process to reassess the file after a formulation, factory, or specification change?
The appropriate response to a gap is not to infer compliance. It is to request a scoped answer, update the intended-use brief, or obtain qualified regulatory advice where the decision requires it.
